Liberdade e consentimento na era digital : uma leitura hermenêutico-filosófica da LGPD no processo eleitoral

Abstract

Trata-se de artigo que visa estudar a liberdade e o consentimento na era digital e, principalmente, as suas influências sobre o processo eleitoral e sua legalidade. O principal objetivo do texto é investigar as maneiras pelas quais a nova realidade comunicacional afeta a formação da vontade política eleitoral, tendo, para isso, realizado pesquisa bibliográfica acerca do tema. É possível concluirmos que a realidade informacional de nossos tempos conduz ao paradigma da pós-verdade, na qual os indivíduos e os eleitores em geral formam e assimilam sua noção de verdade não em consonância com pressupostos racionais, mas sim por meio da confirmação do conteúdo transmitido às suas crenças já estabelecidas, em um viés cognitivo que visa preservar suas próprias crenças, evitando o desconforto do confronto.

It aims to study freedom and consent in the digital age and, especially, its influences on the electoral process and its legality. The main objective of the text is to investigate the ways in which the new communicational reality affects the formation of electoral political will, having, for this, conducted bibliographic research on the subject. It is possible to conclude that the informational reality of our times leads to the paradigm of post-truth, in which individuals and voters in general form and assimilate their concept of truth not in line with rational assumptions, but through confirmation of the content transmitted to their already established beliefs, in a cognitive bias that aims to preserve their own beliefs, avoiding the discomfort of confrontation.
