Considerações sobre ideologia partidária e deliberação democrática

Abstract

Teorizações defendidas pelo Supremo Tribunal Federal acerca de um Estado de Partidos subsidiaram a compreensão de uma nova configuração do regime democrático, conferindo às agremiações o papel central na democracia, rompendo com a ideia de liberdade na atuação dos parlamentares, frequentemente relacionada às democracias liberais. A base da argumentação adjacente à proeminência dos partidos repousa no alegado fato de que o eleitor encontraria no estatuto partidário o arcabouço axiológico orientador da atuação do partido, garantindo a previsibilidade do comportamento dos representantes nas casas legislativas. Todavia, tal constatação não se faz presente no cenário jurídico e social brasileiro, na medida em que, de modo geral, os valores professados nos estatutos partidários guardam maior correlação a instrumentos meramente alegóricos de discurso, não encontrando densidade suficiente para servir como orientação parlamentar. Restringir a capacidade deliberativa dos atores legislativos ao programa e deliberações partidárias acaba por romper a própria lógica do regime democrático, uma vez que inviabiliza o necessário debate racional e eficaz na tomada das decisões políticas.

Theories defended by the Supreme Court about a State of Parties supported the understanding of a new configuration of the democratic regime, giving the associations the central role in democracy, breaking with the idea of freedom in the performance of parliamentarians, often related to liberal democracies. The basis of the argument adjacent to the prominence of the parties is contained in the fact that the voter would find in the party statute the axiological substrate that guides the party's performance, guaranteeing the predictability of the behavior of representatives in the legislative houses. However, this finding is not present in the Brazilian legal and social scenario, as, in general, the values professed in the party statutes are more closely related to merely allegorical instruments of discourse, not finding sufficient density to serve as parliamentary guidance. Restricting the deliberative capacity of legislative actors to the program and party deliberations ends up breaking the logic itself of the democratic regime, since it makes the necessary rational and effective debate in the making of political decisions unfeasible.
