A reforma política : entre a governança e o sistema eleitoral

Abstract

It intends to correlate the Brazilian governance model with the open list system to understand the main negative consequences between the two institutes. It is noted that the electoral legislation imposes a significant number of electoral obligations to the candidate which results in the increase of the inspection from the electoral agencies and the judicialization of the elections. Afterwards, a quantitative study is carried out on the potential increase in processes distributed in the Electoral Court and its relationship with the so-called third round of the elections. Finally the study intends to suggest some directions for electoral reform.

Pretende correlacionar o modelo de governança brasileira com o sistema de lista aberta, com o fito de compreender quais as principais consequências negativas dos dois institutos. Constata-se que a legislação eleitoral atribui um número expressivo de obrigações eleitorais ao candidato, o que resulta no aumento da fiscalização e, consequentemente, da judicialização das eleições. Depois disso, realiza-se estudo quantitativo sobre o potencial aumento de processos distribuídos na Justiça Eleitoral e a sua relação com o denominado terceiro turno das eleições. Por fim, o estudo pretende sugerir algumas direções para a reforma eleitoral.
