Implicações legais no período pré-eleitoral

Abstract

O Direito Eleitoral brasileiro se encontra em pleno amadurecimento e, nesse procedimento de autoaperfeiçoamento, enfrenta questões delicadas que clamam por solução imediata do Poder Legislativo e do Poder Judiciário. Porém, há lacunas e indefinições legais que permitem interpretações incongruentes entre si, gerando desequilíbrio na disputa eleitoral e insegurança jurídica, principalmente no período que antecede a disputa, o chamado período pré-eleitoral. Quem mais se fere nesse cenário de contenda entre a vontade popular sufragada nas urnas e a judicialização do processo eleitoral é a própria democracia. A Justiça Eleitoral avança sobre temas de competência de outro poder, sobretudo nos últimos pleitos, contudo, pontos críticos da legislação carecem de enfrentamento pelo Legislativo e extrema prudência e parcimônia do Judiciário.

The Brazilian electoral law is in full development, and in this procedure of self-improvement, it currently faces delicate issues that cry out for immediate solution from the Legislative and the Judiciary Powers. However, there are gaps and uncertainties that allow legal interpretations inconsistent with each other, creating an imbalance in the electoral dispute and legal uncertainty, especially in the period preceding the contest, called Pre-Election Period. Who gets more hurt in this scenario of strife between the people s will suffraged at the polls and the judicialization of the electoral process is democracy itself. The Electoral Court clearly advances on issues of jurisdiction of another power, especially in recent elections, however, there are critical points of the legislation that need to be faced by the Legislative and extreme prudence and parsimony of the Judiciary.
