Justiça Eleitoral : um desafio à separação de poderes

Abstract

Redefine a separação de poderes e propõe um modelo adequado ao sistema jurídico brasileiro a partir do estudo das funções estatais desempenhadas pela Justiça Eleitoral. A Justiça Eleitoral desafia concepções tradicionais de separação de poderes, ao concentrar funções tanto judiciais típicas quanto administrativas, normativas e consultivas. Além disso, a natureza das questões colocadas sob a jurisdição eleitoral torna ingênua a concepção amplamente difundida e, em geral, não-problematizada de que juízes não devem decidir questões políticas.It redefines the separation of powers and propose a suitable model to the Brazilian legal system from the study of the state functions performed by the Electoral Justice. The Electoral Justice challenges traditional conceptions of separation of Powers by concentrating both typical judicial, administrative, normative and consultative functions. Besides, the nature of issues under electoral jurisdiction shows how naive is the widely held and generally uncontroversial notion that judges should not decide political issues.
