Sistema eleitoral misto ou voto distrital puro

Abstract

Propõe-se a comparar o sistema eleitoral misto, majoritário e proporcional, originalmente proposto pela Comissão do Ministério da Justiça, e o projeto de lei encaminhado ao Congresso Nacional pelo presidente João Figueiredo. O projeto apresentado pelo presidente da República recebeu profundas alterações, por sugestão de dirigentes políticos do PDS. O projeto de lei sobre o voto distrital misto, apresentado pelo ministro Ibrahim Abi-Ackel, revela, ao ser examinado superficialmente, uma natureza distrital plurinominal disfarçada de proporcional. As principais críticas se referem à possibilidade de diminuição da participação dos filiados nos partidos, aumento das possibilidades de corrupção partidária e negação da premissa da representação proporcional em nível estadual. A proposta resulta na municipalização do pleito, sem se diferenciar significativamente do sistema majoritário distrital puro. O projeto transformaria a eleição em uma disputa entre dois candidatos por partido, mantendo a vinculação dos votos e não alterando a natureza distrital do processo desde a indicação até o preenchimento das cadeiras. Assim, pode-se afirmar que o projeto do ministro Abi-Ackel compromete a representação proporcional e favorece distorções no sistema eleitoral.It aims to compare the mixed, majority and proportional electoral system, originally proposed by the Department of Justice Commission, and the bill sent to the National Congress by President João Figueiredo. The project presented by the President of the Republic received profound changes, at the suggestion of PDS political leaders. The bill on mixed district voting, presented by Secretary of Justice Ibrahim Abi-Ackel, reveals, when superficially examined, a multi-member district nature disguised as proportional. The main criticisms refer to the possibility of a decrease in the participation of party members, an increase in the possibility of party corruption, and the denial of the premise of proportional representation at the state level. The proposal results in the municipalization of the election, without significantly differentiating from the pure district majority system. The project would transform the election into a dispute between two candidates per party, maintaining the binding of votes and not changing the district nature of the process from nomination to filling seats. Therefore, it can be said that Secretary Abi-Ackel's project compromises proportional representation and favors distortions in the electoral system.
