A análise econômica da adi nº 4.650 e a proibição de doações eleitorais feitas por pessoas jurídicas

Abstract

Tem como foco examinar, à luz da Análise Econômica do Direito, se a decisão proferida pelo Supremo Tribunal Federal, no âmbito da ADI nº 4.650, que declarou inconstitucional a possibilidade de doação feita por pessoa jurídica para campanhas eleitorais, alcançou a finalidade desejada pela Corte: afastar a influência do poder econômico sobre o poder político nas eleições. A Análise Econômica do Direito se faz útil neste estudo para demonstrar por meio de ferramentais empíricos de desenho comportamental se as consequências da decisão estão em consonância com o desejo dos ministros ou não. A hipótese adotada é a de que o julgado do STF foi "um tiro que saiu pela culatra" porque não fomentou uma estrutura de incentivos hábeis a afastar a influência do empresariado sobre os políticos, além de ter fomentado um cenário propício para a criação do Fundo Especial de Financiamento de Campanha (FEFEC), que destinou para as campanhas eleitorais verbas originalmente concebidas para investimento em setores necessários à população brasileira. A bibliografia e a consulta a dados financeiros fornecidos pelo Tribunal Superior Eleitoral foram os métodos de pesquisa empregados no presente trabalho.It focuses on examining, using the methods of the Economic Analysis of Law, if the decision of the Brazilian's Supreme Court, in the judgment of the ADI nº 4.650, which declared unconstitutional the possibility of donation made by legal entitys in the electoral campaigns, achieved the purpose desired: to remove the influence of economic power over politicians in the elections. The Economic Analysis of Law is useful in this study to demonstrate, through empirical tools of behavioral design, whether the consequences of the decision within the judges aspirations or not. The hypothesis adopted is that the judgment was "backfired shot" because it did not created a structure of incentives capable of removing the influence of the economic power on politicians, in addition to stimulating a scenario for the creation of the Special Fund for Financing Campaings (FEFEC, in portuguese), which earmarked money originally destinated for investment in sectors needed by the Brazilian population and relocated to the electoral campaigns. The study of bibliography and the financial data provided by the Brazilian's Superior Electoral Court were the research methods used in this work.
