Judicialização das eleições : perfil dos casos de abuso de poder no Tribunal Superior Eleitoral

Abstract

Objetiva estudar o fenômeno da judicialização das eleições no âmbito do Tribunal Superior Eleitoral (TSE). Procura pesquisar o fenômeno específico das ações eleitorais que discutem o abuso de poder. A hipótese de trabalho é que os julgados levantados poderiam revelar se existe o fenômeno da judicialização dos resultados eleitorais. Segundo a Constituição de 1988, o TSE tem a competência para gerir, em última instância, o processo eleitoral, que compreende as etapas de organizações das eleições, julgamento dos litígios eleitorais e validação dos resultados. Portanto, a possibilidade de contestações da validade dos mandatos, segundo uma lógica de controle judicial da competição, é um dos pontos centrais de nosso sistema de regulação eleitoral. Procura-se responder, segundo uma perspectiva quantitativa, se há judicialização das eleições, testando a hipótese. Será empregada a metodologia de pesquisa empírica em direito denominada jurimetria, explicada em tópico próprio.

It aims to study the phenomenon of the judicialization of elections within the scope of the Superior Electoral Court (TSE). It seeks to research the specific phenomenon of electoral actions that discuss the abuse of power. The hypothesis of the work is that the judgments raised could reveal whether there is a phenomenon of judicialization of electoral results. According to the 1988's Brazilian Constitution, the TSE has the competence to ultimately manage the electoral process, which comprises the stages of election organizations, the resolution of electoral disputes and the validation of results. Therefore, the possibility of contesting the validity of the mandates, according to a logic of judicial control of competition, is one of the central points of our electoral regulatory system. It seeks to answer, from a quantitative perspective, whether there is judicialization of the elections, testing the hypothesis. Empirical legal research methodology called jurimetry will be used, explained in a specific topic.
