Mandato coletivo : inovação democrática ou risco à representatividade?

Abstract

Analisa o instituto do mandato coletivo sob a perspectiva da inovação democrática, questionando seu impacto na representatividade política no contexto do Direito Eleitoral brasileiro. Apresenta-se uma fundamentação teórica sobre os conceitos de representatividade e democracia participativa, destacando as tensões entre o mandato individual tradicional e a proposta de um exercício coletivo do mandato eletivo. Explora-se a origem, características e a atual ausência de regulamentação jurídica do mandato coletivo no Brasil, ressaltando o acordo político informal que o embasa e as principais questões jurídicas que suscita. A análise crítica contrapõe os potenciais benefícios do mandato coletivo, como maior pluralidade e participação social, aos riscos relacionados à insegurança jurídica, diluição da responsabilidade política e desafios para a legitimidade representativa. Por fim, o artigo oferece considerações finais que sintetizam o debate e propõem reflexões, enfatizando os principais pontos favoráveis e contrários ao mandato coletivo, focando nas implicações teóricas e conceituais no campo eleitoral.

It examines the legal construct of the "mandato coletivo" (collective mandate) from the perspective of democratic innovation, questioning its impact on political representativeness within the framework of Brazilian Electoral Law. It sets forth a theoretical foundation on the concepts of representativeness and participatory democracy, highlighting the tensions between the traditional individual mandate and the proposal of a collective exercise of the elective office. The study explores the origin, defining features, and the current absence of formal legal regulation of the collective mandate in Brazil, emphasizing the informal political agreement that underpins it and the main legal issues it raises. The critical analysis contrasts the potential benefits of the collective mandate - such as enhanced pluralism and social participation - with the risks associated with legal uncertainty, the dilution of political accountability, and challenges to representative legitimacy. Finally, the article presents concluding remarks that synthesize the debate and offer reflections, underscoring the main arguments in favor of and against the collective mandate, with particular focus on its theoretical and conceptual implications in the electoral field.
