Reflexões sobre as eleições 2020 em tempos de pandemia

Abstract

Aborda a realização das eleições 2020 em meio a uma pandemia. Considerando que o grave quadro sanitário pode se prolongar até o mês das eleições, é normal o surgimento de dúvidas e incertezas acerca do cumprimento do calendário eleitoral. O adiamento do dia da eleição desde que realizada no ano em curso, a prorrogação dos mandatos dos prefeitos e vereadores, o voto on-line e o voto por carta aparecem como soluções para que o vírus não seja disseminado e as determinações da Organização Mundial da Saúde sejam obedecidas. Abordou-se que o direito ao voto é uma cláusula pétrea insculpida na Constituição Federal de 1988 e que a Justiça Eleitoral pode utilizar novas alternativas tecnológicas, já utilizada em outros Países, para que seja garantido o direito ao sufrágio universal, evitando, assim, eventual falta de legitimidade eleitoral dos governantes. Em seguida, são apresentadas as conclusões obtidas.

It addresses the holding of the 2020 elections in the midst of a pandemic. Considering that the serious health situation can last until the month of the elections, it is normal for doubts and uncertainties to arise regarding the fulfillment of the electoral calendar. The postponement of election day since it was held this year, the extension of the terms of mayors and councilors, online voting and voting by letter appear as solutions to prevent the virus from being disseminated and the determinations of the World Health Organization Health are obeyed. It was discussed that the right to vote is a stone clause inscribed in the Federal Constitution of 1988 and that the Electoral Justice can use new technological alternatives, already used in other countries, so that the right to universal suffrage is guaranteed, thus avoiding eventual lack of electoral legitimacy of government officials. Then, the conclusions obtained are presented.
