O Ministério Público no exercício da função eleitoral

Abstract

Analisa a atuação do Ministério Público na área eleitoral, abordando aspectos concernentes ao seu regime normativo, estrutura e organização institucional, além da natureza e amplitude de tal função. A partir do exame da modelagem estabelecida sobre o Ministério Público brasileiro na Constituição de 1988 e nas leis, busca-se situar o exercício da função eleitoral e a organização institucional nos diversos níveis. O estudo abrange também questões alusivas ao ofício eleitoral do Ministério Público, como parte ou fiscal da ordem jurídica, destacando a sua importância e imprescindibilidade para a garantia da lisura e normalidade do processo eleitoral.

It analyzes the role of the Public Prosecutor in the electoral area, addressing aspects related to its normative regime, institutional structure and organization, as well as the nature and extent of such a function. From the examination of the modeling established on the Brazilian Public Ministry in the Constitution of 1988 and in the laws, it is sought to situate the exercise of the electoral function and the institutional organization in the several levels. The study also covers issues related to the electoral office of the Public Prosecutor's Office, as part or fiscal of the legal order, highlighting its importance and indispensability to guarantee the smoothness and normality of the electoral process.
