Impeachment, relações entre direito e política e accountability no Brasil atual

Abstract

Defende que análises sobre o momento atual da política brasileira, em especial sobre o tema do impeachment e demais responsabilizações dos agentes políticos, devem orientar-se por conceitos e abordagens que contemplem a dimensão histórica e os arranjos político-institucionais. O artigo usa bases teóricas dos estudos do Direito e da Ciência Política para analisar o momento atual e criticar o uso de termos como judicialização da política ou moralização da política. Como conclusão afirma que a noção de accountability horizontal deve ser incorporada aos estudos do Direito que visam analisar o momento político atual e suas relações com a necessária consolidação do Estado Democrático de Direito no BrasilIt argues that analysis of the current Brazilian politics, especially on the impeachment and other accountabilities of political agents, should be guided by concepts and approaches that address the historical dimension and the political and institutional arrangements. The article uses theoretical bases of Law and Political Science studies to analyze the current situation and criticize the use of terms such as judicialization of politcs and moralization of politics. The conclusion it states that horizontal accountability concept should be incorporated into the studies of Law aimed at analyzing the current political situation and its relations with the consolidation of the democratic Rule of Law in Brazil
