Crimes contra a honra e a verdade nas campanhas eleitorais na internet

Abstract

Analisa a inter-relação existente entre os delitos tipificados nos artigos 323 a 326 do Código Eleitoral e a verdade nas campanhas eleitorais por meio da internet. Inicia-se com a breve contextualização dos crimes contra a honra e a verdade nas campanhas eleitorais. Em seguida, analisa o crime de divulgação de fatos sabidamente inverídicos, previsto no art. 323 do Código Eleitoral e, na sequência, há um tratamento mais aprofundado dos crimes de calúnia, difamação e injúria previstos nos artigos 324 a 326 do Código Eleitoral. Por derradeiro, são jogadas luzes para alguns aspectos da inter-relação existente entre os crimes contra a honra em matéria eleitoral e a verdade nas campanhas eleitorais.It analyzes the interrelationship between the offenses typified in articles 323 to 326 of the Electoral Code and the truth in electoral campaigns through the internet. It begins with a brief contextualization of crimes against honor and truth in electoral campaigns. Then, the crime of disclosing facts known to be untrue, contained in the art. 323 of the Electoral Code and there will be a more in-depth treatment of the crimes of defamation, libel and insult contained in articles 324 to 326 of the Electoral Code. Finally, light will be shed on some aspects of the interrelationship between crimes against honor in electoral matters and the truth in electoral campaigns.
