Fidelidade partidária no direito brasileiro

Abstract

A intensiva migração partidária verificada entre parlamentares brasileiros é incompatível com um sistema eleitoral sério e democrático, principalmente diante da adoção de eleições proporcionais para Casas Legislativas. Procurar-se-á demonstrar, neste artigo, que a inibição desta prática demanda o fortalecimento dos partidos políticos, sendo essencial para tanto promover a efetividade do instituto da fidelidade partidária, notadamente a partir da elaboração de normas que estabeleçam sanções punitivas aos representantes infiéis que, injustificadamente, deixarem o partido sob cuja legenda se elegeram.The intensive partisan migration verified between Brazilian parliamentarians is incompatible with a serious and democratic electoral system, mainly ahead of the adoption of proportional elections for Legislative Houses. It will be looked to demonstrate, in this article, that the inhibition of this practice demand the strengthness of the political parties, being essential in such a way to promote the effectiveness of the institute of the partisan allegiance, notably from the elaboration of norms that establish punitive sanctions to the disloyal representatives who, unreasonably, leave the party under whose legend they had been elected.
