A distribuição do Fundo Partidário frente à questão da igualdade de acesso à disputa democrática

Abstract

Analisa a forma de distribuição do Fundo Partidário no Brasil. O modelo adotado no país foi analisado por meio da legislação, da doutrina e da jurisprudência referentes ao tema, de modo a verificar se a medida garante a igualdade de acesso a todos os candidatos nas disputas para cargos eleitorais. Primeiramente, abordam-se os estudos de Norberto Bobbio sobre a igualdade. Após isso, explana-se o princípio da igualdade à luz da Constituição Federal de 1988, adentrando-se na questão do direito à igualdade política, ao Estado e à democracia. A abordagem da Teoria de Dworkin se faz indispensável para a conclusão final. A explicação do que é o Fundo Partidário e como se dá sua distribuição sequencia o trabalho. Observa-se que há anos os mesmos grupos políticos se perpetuam no poder, fato que não reflete um Estado democrático de direito ideal. Verificou-se que os que possuem maior poder aquisitivo têm mais chances de acesso a cargos políticos, ferindo o princípio da igualdade.It analyzes the distribution of the party fund in Brazil. Through legislation, doctrine and jurisprudence related to the subject, an analysis was made of the model adopted in the country and whether or not it guarantees equal access for all candidates in disputes for electoral positions. First, Norberto Bobbios studies on equality were discussed. Afterwards, an explanation of the principle of equality was made in light of the Federal Constitution of 1988, entering into the issue of the right to political equality, State and Democracy. The approach of the Dworkin Theory, became indispensable to arrive at the final conclusion. The explanation of what the partisan fund is and how its distribution occurs sequentially the work. It is observed that for years the same political groups have perpetuated themselves in power, a fact that does not reflect an ideal Democratic State of Right. It is verified that those who have a greater purchasing power have greater chances of access to political positions, violating the principle of equality.
