Resumo
Busca uma análise mais aprofundada sobre o instituto da inelegibilidade
reflexa parental, em especial daquela que recai sobre o cônjuge que se
divorcia do titular do cargo de chefe do Poder Executivo no curso de seu mandato,
conforme previsto no art. 14, § 7º da Constituição Federal e na Súmula Vinculante
nº 18 do Supremo Tribunal Federal. É cediço que tanto o Supremo Tribunal Federal
e os Tribunais Eleitorais já sedimentaram o entendimento de que o simples fato de
o casal ter se divorciado no curso do mandato não afasta a inelegibilidade prevista
no referido dispositivo constitucional. Todavia, a ratio do Constituinte Originário era
obstar o monopólio do poder político por grupos hegemônicos ligados por laços
familiares. Assim, caso um dos cônjuges contraia novo matrimônio ou união estável,
verificar-se-á a formação de novo núcleo familiar, transferindo-se a inelegibilidade reflexa
parental, que antes recaía sobre o ex-cônjuge, para o atual, que passa a integrar
o núcleo familiar do titular do cargo. Por fim, conclui-se que a inelegibilidade reflexa
prevista no art. 14, § 7º da Constituição Federal e na Súmula Vinculante nº 18 do
Supremo Tribunal Federal não deve ser aplicada de forma automática, devendo-se
analisar o caso concreto para verificar a possibilidade de seu afastamento, especialmente
nos casos de constituição de novos núcleos familiares.
It provides an in-depth analysis of the legal concept of reflective ineligibility due to kinship, focusing on spouses who divorce a sitting chief executive during their term of office, as established by Article 14, § 7 of the Federal Constitution and the Supreme Federal Court's Binding Precedent No. 18. It is well-established in the jurisprudence of both the Supreme Federal Court and the Electoral Courts that a divorce during the term of office does not, by itself, remove the ineligibility set forth in the aforementioned constitutional provision. However, the original intent of the Constitution's framers was to prevent the monopolization of political power by hegemonic groups linked by family ties. Therefore, should the officeholder enter into a new marriage or stable union, a new family nucleus is formed. This would transfer the reflective ineligibility from the former spouse to the current spouse, who now becomes part of the office-holder's immediate family. Finally, this paper concludes that the reflective ineligibility established by Article 14, § 7 of the Federal Constitution and Binding Precedent No. 18 should not be applied automatically. Instead, a case-by-case analysis is required to assess the possibility of setting aside this ineligibility, especially in cases where a new family nucleus has been formed.
