O debate sobre as eleições municipais de 2020 no Brasil e a pandemia da Covid-19

Abstract

A eventual impossibilidade de realizar as eleições municipais de 2020 devido à pandemia da Covid-19 reacendeu o antigo debate sobre a unificação das eleições no Brasil. Com base em pesquisa bibliográfica e documental, este artigo analisa como a Constituição e as normas internacionais de direitos humanos regulam tanto a hipótese de unificação quanto de adiamento das eleições. Conclui-se que, desde que seja preservada a periodicidade, não há afronta à democracia. Contudo, em última instância, a decisão é política.The eventual impossibility of holding the 2020 municipal elections due to the Covid-19 outbreak has re-kindled old debates over the unification of elections in Brazil. Based on bibliographic and documental research, this paper analyses the ways the Constitution and the human rights international laws address the issues of election unification and postponement. The conclusion is arrived that, provided periodicity is preserved, there is no affront whatsoever to democracy. However, the ultimate decision is political.
