A competência para o julgamento das contas de convênio geridas por ex-prefeitos

Abstract

Realiza uma análise objetiva e jurispruidencializada acerca da competência para o julgamento das contas de convênio geridas por ex-prefeitos e a inelegibilidade prevista na alínea "g", do artigo 1°, inciso I, da Lei Complementar n° 64/1990. Em 2016 o E. Supremo Tribunal Federal, ao analisar os Recursos Extraordinários n°s 729744 e 848826, fixou entendimento de que o parecer técnico elaborado pelo Tribunal de Contas, tem natureza meramente opinativa, competindo exclusivamente à Câmara de Vereadores o julgamento das contas anuais referentes a atos de governo e a atos de gestão do chefe do Chefe do Poder Executivo local, sem, contudo, dispor sobre as contas de convênios, não havendo a classificação do ato do governante, quando gestor desses contratos. Assim, coube à Justiça Eleitoral, a partir do exame dos casos concretos, nortear e dar contornos definitivos sobre o tema, restando descrita a trajetória das discussões realizadas nos Tribunais no presente artigo.

It performs an objective and jurisprudential analysis of the jurisdiction for the judgment of the accounts of the agreement managed by former mayors and the ineligibility foreseen in item "g" of article 1, item I, of Complementary Law n. 64 /nineteen ninety. In 2016, the Federal Supreme Court, when examining Extraordinary Remedies Nos. 729744 and 848826, established that the technical opinion prepared by the Court of Auditors is purely opinionated, and it is the responsibility of the City Council to judge the annual accounts referring to acts of government and acts of management of the head of the local Executive Branch, without, however, disposing of the accounts of agreements, and there is no classification of the act of the ruler, when manager of these contracts. Thus, it was up to the Electoral Court, based on the examination of the concrete cases, to guide and give definite contours on the subject, and the trajectory of the discussions held in the Courts in this article is described.
