O abuso de poder religioso frente à constituição democrática e a hipótese de cassação de mandato pela Justiça Eleitoral

Abstract

Pretende demonstrar as fronteiras da ideia do abuso de poder religioso e sua abordagem enquanto abuso de direito. O abuso de poder religioso merece especial atenção no Brasil, visto que a política está presente nestes ambientes e, assim, é necessária alguma chave interpretativa, paliando os dispositivos constitucionais, bem como respeitando a ideia da liberdade, do progresso e da mútua cooperação. Dessa forma, procuram-se espaços regularizados e livres do abuso de poder religioso.It intends to demonstrate the frontiers of the idea of abuse of religious power as a type of abuse of law. The abuse of religious power deserves special attention in Brazil, since politics is present in settings of religious worship. Hence, an interpretive key is necessary, palliating the constitutional provisions, as well as respecting the idea of freedom, progress and mutual cooperation. In the final analysis, it is necessary to establish regularized spaces free from the abuse of religious power.
