Inteligência artificial e democracia : análise jurídica do uso de deepfake em contexto eleitoral à luz da jurisprudência do TRE-MA

Resumo
O avanço das tecnologias de inteligência artificial (IA) tem provocado profundas
transformações na dinâmica das comunicações e do processo eleitoral, com destaque para os
riscos decorrentes do uso de deepfakes. Essa técnica de manipulação audiovisual, ao mesmo
tempo em que pode ser utilizada para fins legítimos, apresenta elevado potencial de comprometer
a integridade do pleito, a confiança social e a proteção da honra dos indivíduos. O presente
artigo analisa a interseção entre inteligência artificial e democracia, a partir da Resolução TSE
nº 23.732/2024 e do julgamento paradigmático do Tribunal Regional Eleitoral do Maranhão
(TRE-MA), que examinou a divulgação de vídeo satírico manipulado por IA em Icatu-MA. A
pesquisa combina análise normativa e jurisprudencial, buscando compreender como a Justiça
Eleitoral tem equilibrado a vedação ao uso de deepfakes com a proteção da liberdade de expressão
no contexto político. Conclui-se que a Resolução TSE nº 23.732/2024 inaugura um marco
regulatório relevante ao impor restrições rigorosas e transparência obrigatória na utilização
de conteúdos sintéticos, ao mesmo tempo em que a jurisprudência reafirma a necessidade de
distinguir manipulações tecnológicas nocivas da legítima crítica política, inclusive em forma
humorística. No caso paradigmático julgado pelo TRE-MA, concluiu-se que a veiculação de
conteúdo satírico com uso de deepfake rudimentar, sem pedido explícito de não voto, sem ofensa
manifesta à honra e sem divulgação de fato sabidamente inverídico, não configura propaganda
eleitoral antecipada negativa, sendo amparada pela liberdade de expressão constitucional.
The rapid advancement of artificial intelligence (AI) technologies has deeply transformed communication dynamics and electoral processes, with particular concern regarding the risks posed by deepfakes. While this audiovisual manipulation technique can be used for legitimate purposes, it also carries a high potential to undermine electoral integrity, social trust, and individual reputation. This article examines the intersection between artificial intelligence and democracy, focusing on Brazilian Electoral Court Resolution No. 23.732/2024 and a landmark decision of the Regional Electoral Court of Maranhão (TRE-MA), which addressed the dissemination of a satirical AI-generated video in Icatu-MA. The research combines normative and case law analysis, seeking to understand how Electoral Justice has balanced the prohibition of deepfakes with the protection of freedom of expression in political contexts. The study concludes that Resolution No. 23.732/2024 establishes a significant regulatory framework by imposing strict restrictions and mandatory transparency in the use of synthetic content, while case law reaffirms the need to distinguish harmful technological manipulations from legitimate political criticism, including satire. In the paradigmatic case adjudicated by the TRE-MA, it was concluded that the dissemination of satirical content using a rudimentary deepfake, without an explicit request for voters to refrain from voting, without a manifest offense to honor, and without the disclosure of a knowingly false fact, does not constitute negative early electoral propaganda, and is protected by constitutional freedom of expression.
