Atuação judicial no "jogo político-eleitoral" : fronteiras entre o político e o jurídico

Abstract

Investiga os campos e as implicações da atuação judicial na definição do desenho institucional do "jogo político-eleitoral". Em virtude dessa temática percorre-se alguns aspectos das fronteiras entre o político e o jurídico. Busca-se, portanto, compreender qual seria o papel do Judiciário, em geral, e do Supremo Tribunal Federal, em especial, na definição do financiamento misto das campanhas eleitorais. Para tanto, a abordagem empírica analisa as advertências ou precauções da experiência estadunidense, no caso Bush vs. Gore, num "esforço aproximativo" com a ação direta de inconstitucionalidade - ADI n. 4.650/DF. Nesse sentido, conjuga-se a pesquisa empírica, na vertente qualitativa, com os objetivos teórico-exploratório incidindo numa metodologia mista. A hipótese de trabalho consiste em afirmar o papel moderado como potencialmente adequado para a atuação judicial nesse cenário, sob pena de ultrapassar e embaralhar as fronteiras entre o político e o jurídico. Isso, contudo, não representa inatividade judicial. Os resultados obtidos pela pesquisa, confirmam parcialmente a resposta apresentada além de permitirem concluir que a atuação judicial no ambiente testado produz resultados inesperados, daí reforçar uma atuação mais restrita.

We investigate the fields and implications of judicial action in defining the institutional design of the "electoral-political game". By virtue of this thematic, we go through some aspects of the boundaries between the political and the legal. We seek, therefore, to understand what would be the role of the judiciary, in general, and the Supremo Tribunal Federal, in particular, in defining the mixed financing of electoral campaigns. To this end, the empirical approach analyzes the warnings or precautions of the American experience, in the case of Bush vs. Gore, in an "approximate effort" with the ação direta de inconstitucionalidade - ADI n. 4.650/DF. In this sense, we combine a mixed methodology between the empirical research, in the qualitative aspect and the objectives theoretical and exploratory. The working hypothesis consists in affirming the moderate role as potentially adequate for judicial action in this scenario, under penalty of overcoming and blurring the boundaries between the political and the legal. This, however, does not represent judicial inactivity. The results obtained by the research partially confirm the answer presented and allow concluding that the judicial action in the tested environment produces unexpected results, hence reinforcing a more restricted performance.
