Compra de votos e abuso de poder : uma análise das infrações eleitorais à luz da Constituição Federal

Abstract

Sendo o Brasil uma República Federativa assentada no regime democrático de direito, em que o povo elege seus representantes e, considerando que o Direito Eleitoral, ao regular os direitos políticos e o processo eleitoral, mantém íntima relação com a democracia, é imprescindível compreender o voto como instrumento do exercício da cidadania. Neste sentido, a compra de votos e o abuso de poder ao violarem a liberdade de escolha do eleitor, gerando desequilíbrio do pleito eleitoral, acabam por corromper o processo democrático. Compreender o tratamento dispensado pela Constituição Federal às referidas infrações eleitorais é, pois, o objetivo deste trabalho. A metodologia foi delineada por meio do método dedutivo e da pesquisa bibliográfica, sobressaltando a busca de subsídios com a análise da doutrina, da jurisprudência, da legislação eleitoral infraconstitucional e, sobretudo, da própria Constituição Federal de 1988.

Since Brazil is a Federative Republic seated in the democratic rule of law, in which the people elect their representatives and, considering that the Electoral Law, the regular political rights and the electoral process, is intimately related to democracy, it is essential to understand the vote as an instrument of citizenship. In this sense, vote buying and abuse of power by violating the freedom of choice of the voter, generating imbalance in the election campaign, eventually corrupt the democratic process. Understanding the treatment by the Constitution to such electoral offenses is therefore the aim of this work. The methodology was designed by the deductive method and literature, startling the search for grants with the analysis of the doctrine, jurisprudence, the infra electoral legislation and, above all, the very Constitution of 1988.
