Justiça Eleitoral no processo de redemocratização no Brasil

Abstract

Afirma que a Justiça Eleitoral é um divisor de águas na história político-brasileira, pois há um período antes e um depois da existência dessa Justiça especializada, ressaltando que o processo eleitoral é critério-base para a democracia quando o sistema assume o caráter pluralista e aberto. Lembra-se que um regime é qualificado como democrático se propiciar eleições competitivas e garantir o resultado do pleito como expressão fiel da vontade do eleitor. Quando a classe política discute uma reforma político-partidária cujo futuro é desconhecido, o papel da Justiça Eleitoral se torna ainda mais importante. Conclui-se que, desde os anos 30 do século XX, ela se constitui ator político relevante e desempenha papel crucial no cenário político, bem como na busca de aumentar os graus da democracia brasileira.

It affirms that the Electoral Justice is a watershed in Brazilian-political history, since there is a period before and after the existence of this specialized justice, emphasizing that the electoral process is the basic criterion for democracy when the system assumes the pluralist and open. It reminds that a regime is qualified as democratic if it provides competitive elections and guarantee the result of the election as a faithful expression of the will of the elector. When the political class discusses a political-party reform whose future is unknown, the role of the Electoral Court becomes even more important. It concludes that, since the 30s of the twentieth century, it is a relevant political actor and plays a crucial role in the political scenario, as well as in the quest to increase the degrees of Brazilian democracy.
