Inelegibilidade por rejeição de contas

Abstract

Analisa as inelegibilidades, seu conceito, fundamentação e natureza jurídica, com enfoque na inelegibilidade por rejeição de contas prevista no art. 1º, I, g da LC 64/90. Para tanto foram abordados os seus principais aspectos como: conceitos, fundamentos e inelegibilidades em espécies, quais sejam, as constitucionais e as infraconstitucionais ou legais. Em seguida tratou-se da natureza jurídica. Finalmente, objetivando analisar a inelegibilidade por rejeição de contas, destacou-se os pressupostos para sua incidência, o conceito de irregularidade insanável e a configuração do ato doloso de improbidade administrativa.

It aims to highlight the ineligibility of its concept, foundation and legal nature, focusing on the ineligibility for rejection of accounts provided in art. 1, I, g of LC 64/90. In order to do so, the main themes of ineligibility were discussed such as: concepts, foundations and ineligibilities in species, such as constitutional and infraconstitutional or legal. Next, it was a legal matter. Finally, in order to analyze the ineligibility for rejection of accounts, it was highlighted the assumptions for its incidence, the concept of irreparable irregularity and the configuration of the malicious act of administrative improbity.
