Democracia e cassação de mandato pela Justiça Eleitoral

Abstract

Demonstra, através de análise de filosofia política, que a cassação de mandatos eleitorais rompe com o ideal de democracia, de modo que deve ser aplicado estritamente dentro da legalidade. Assim, garante-se a legitimidade democrática do voto popular, sendo a Justiça Eleitoral, quando agindo dentro de seus papéis constitucionais, grande garantidora da ordem jurídica e democrática.

It demonstrates, through analysis of political philosophy, that removal from elected office ruptures the ideal of democracy, so that it must be applied strictly within the bounds of the law. Therefore, the aim must be to guarantee the democratic legitimacy of the popular vote, with the electoral courts, when acting within the bounds of their constitutional roles, act to assure the legal system and democracy.
