A evolução do financiamento eleitoral no Brasil : dimensões jurídica e política

Abstract

Busca compreender o financiamento das campanhas eleitorais no Brasil sob uma perspectiva evolutiva, considerando duas dimensões do fenômeno: a jurídico-positiva e a político-normativa. A primeira tem por consideração a reconstrução histórica do direito positivo brasileiro sobre a matéria, destacando quais os contextos fáticos e jurídicos envolvidos nas sucessivas reformas legislativas. A segunda analisa a evolução dos pressupostos científicos e políticos concernentes ao financiamento eleitoral, identificando-se quatro características marcantes na história brasileira sobre o tema: a restrição ao volume financeiro na campanha, o alto grau de burocratização nos movimentos financeiros e na prestação de contas, o aumento dos mecanismos de "liability" e a tendência à publicização das fontes de financiamento. Ao final, conclui-se pelo caráter marcadamente reativo da legislação eleitoral no campo das finanças das campanhas, o que explica sua volatilidade e dificulta a sistematização de seus institutos. As reformas legislativas mais recentes e as peculiares características do pleito de 2018 reforçam a necessidade, intentada neste artigo, de compreender o fenômeno do financiamento eleitoral sob uma perspectiva científica.

It aims to understand the financing of electoral campaigns in Brazil under an evolution-ary perspective, considering two dimensions of the phenomenon: legal-positive and political-normative. The first is due to the historical reconstruction of Brazilian law on the subject, high-lighting the phatic and legal contexts involved in progressive legislative reforms. The second ana-lyzes the evolution of the scientific and political assumptions regarding electoral financing, identi-fying four essential characteristics in Brazilian history: the restriction of financial volume in the campaign, the high degree of bureaucratization in economic movements and accountability, the increase in liability mechanisms and the tendency to increment public funding sources. In the end, we conclude that electoral legislation is highly reactive in the field of campaign finances, which explains its volatility and makes it difficult to systematize its institutes. The most recent legislative reforms and the peculiar characteristics of the 2018 election reinforce the need, aimed in this arti-cle, to understand the phenomenon of electoral financing from a scientific perspective.
