O Tribunal Superior Eleitoral na vanguarda da concretização do direito à participação das pessoas "trans" no processo eleitoral

Abstract

Investiga através de uma pesquisa documental e bibliográfica, como e em que medida a atuação do Tribunal Superior Eleitoral fortaleceu a proteção do direito das pessoas "trans" no processo eleitoral de 2018. Para tanto, analisa-se a resposta da referida Corte à Consulta nº 0604054-58.2017.6.00.0000, assim como a Resolução nº 23.562/2018 e a Portaria Conjunta nº 01/2018, instrumentos normativos por meio dos quais o Tribunal Superior Eleitoral regulamentou o trâmite administrativo e burocrático da inserção e uso do nome social no processo eleitoral. Explora-se, ainda, a literatura jurídica, política e democrática que traz argumentos favoráveis à adoção de instrumentos jurídicos para inclusão de grupos minoritários na política, tendo vista os direitos de participação serem fundamentais e humanos.

It investigates through a documentary and bibliographical research, how and to what extent the performance of the Electoral Superior Court in Brazil strengthened the protection of the right of trans persons (transgender) in the electoral process of 2018. To do so, the Court's response to the Consultation No. 0604054- 58.2017.6.00.0000, as well as Resolution 23.562/2018 and Joint Ordinance No. 01/2018, normative instruments by means of which the Electoral Superior Court regulated the administrative and bureaucratic process of the insertion and use of the social name in the electoral process. It also explores legal, political and democratic literature that favors the adoption of legal instruments for the inclusion of minority groups in politics so that the rights of participation are fundamental and human.
