Abstract

Discute a inserção do Direito Eleitoral no atual sistema jurídico, enfatizando os novos paradigmas, a constitucionalização do Direito e as transformações essenciais que esse sofreu nas últimas décadas, sobretudo no que concerne à metodologia e à interpretação. Destaca o novo papel reservado aos princípios, que deixaram de ser concebidos como elementos subalternos no sistema e passaram a desempenhar função fundamental, sendo-lhes reconhecida juridicidade e normatividade imediata. Conclui, apresentando os fundamentos da responsabilidade eleitoral.It discusses the inclusion of the Electoral Law in the current legal system, emphasizing the new paradigms, the constitutionalization of the law and the essential changes that this has in recent decades, especially with regard to methodology and interpretation. Highlights the new role assigned to the principles, which are no longer conceived as subordinate elements in the system and began to play key role, and they are recognized and juridical normativity shown. It concludes by presenting the fundamentals of electoral responsibility.
