Mandatos coletivos e compartilhados no Brasil : vanguarda ou atraso?

Abstract

Analisa a participação cidadã no Poder Legislativo brasileiro por meio dos mandatos coletivos e compartilhados. O objetivo central é avaliar a constitucionalidade dessa prática política e sua efetividade em responder às demandas de representatividade no País. Ao fim da análise, argumenta-se que os mandatos coletivos e compartilhados não são um modelo novo de representação, dificultam a formação de consensos e fragilizam a democracia. Conclui-se que não resolvem o problema da representação política e sua natureza de mandato imperativo conflita com a Constituição.

It analyzes citizen participation in the Brazilian Legislative Branch through collective and shared mandates. The main objective is to analyze the constitutionality of this political practice and to verify its effectiveness in responding to the demands of representation in Brazil. At the end of the analysis, one argues that collective and shared mandates are not a new model of representation, make consensus building more difficult, and weaken democracy. The conclusion is that collective and shared mandates do not solve the problem of political representation, and their nature as imperative mandates conflicts with the current Constitution.
