A representatividade democrática e o papel contramajoritário da Justiça Eleitoral

Abstract

Busca demonstrar que o Judiciário, especificamente a Justiça Eleitoral, ao julgar a cassação de mandatos eleitorais, deve agir com autocontenção, restringindo-se a seu papel constitucional. Isso se deve pelo sistema em que a sociedade brasileira é construída, o sistema democrático, que pressupõe a vontade popular como protagonista do poder.

It aims to demonstrate that the judiciary, specifically the electoral courts, in judging case of potential removal from elected office, should exercise selfrestraint, staying within the bounds of their constitutional role. This is due to the foundation on which Brazilian society is built, which presupposes the popular will as the basis of power.
