A reforma política brasileira à luz dos institutos plebiscito e referendo : mais uma proposta à democracia

Abstract

A Constituição Brasileira prevê que o poder emana do povo, no entanto, não tem tradição de utilizar os instrumentos de participação direta popular, notadamente, Plebiscito e Referendo. Nesse sentido, essa pesquisa desperta um olhar para a importância da utilização desses institutos nas deliberações do governo, como forma de inserir e incentivar o povo a participar de decisões fundamentais para o desenvolvimento do país, em especial, a Reforma Política. Este estudo tematizou a reforma política brasileira à luz dos institutos da democracia semidireta plebiscito e referendo. Tem-se como objetivo geral demonstrar qual instituto da democracia semidireta plebiscito ou referendo seria o mais adequado a ser utilizado em uma reforma política no Brasil. Especificamente buscou pesquisar o contexto político e social para o exercício da democracia no Brasil, conceituar plebiscito e referendo e sua aplicabilidade nas Constituições brasileiras, e por fim, analisar qual mecanismo de participação popular, plebiscito ou referendo, melhor oportuniza o exercício da soberania popular e os posicionamentos sobre a proposta de utiliza-los em uma reforma política no Brasil. O método de estudo figura-se dedutivo, partindo-se de teorias e leis gerais para a análise e explicação de fenômenos particulares. Conclui-se que, o plebiscito é concebido como a aquisição de maior relevância para a efetivação da soberania popular, e que a participação popular, tão importante na conquista da democracia, denota-se essencial para as decisões relevantes voltadas a definir a reforma política no Brasil.

The Brazilian Constitution provides that the power emanates from the people, however, has no tradition of using the instruments of popular direct participation, notably Plebiscite and Referendum. In this sense, this research raises a glance at the importance of the use of these institutes in the deliberations of the government, as a way of inserting and encouraging the people to participate in fundamental decisions for the country's development, especially Political Reform. This study highlighted the Brazilian political reform in the light of the institutes of the semi-direct plebiscite and referendum democracy. It has as a general objective to demonstrate which institute of semi-direct democracy plebiscite or referendum would be the most appropriate to be used in a political reform in Brazil. Specifically, it sought to research the political and social context for the exercise of democracy in Brazil, to conceptualize plebiscite and referendum and its applicability in the Brazilian Constitutions, and finally, to analyze which mechanism of popular participation, plebiscite or referendum, better affords the exercise of popular sovereignty and The positioning on the proposal of using them in a political reform in Brazil. The method of study is deductive, starting from theories and general laws for the analysis and explanation of particular phenomena. We conclude that the plebiscite is conceived as the acquisition of greater relevance for the realization of popular sovereignty, and that popular participation, so important in the conquest of democracy, is essential for the relevant decisions aimed at defining political reform in the Brazil.
