Imunidade constitucional e o limite da liberdade de expressão dos parlamentares

Abstract

Sob uma perspectiva inicial, pode-se dizer que o Poder Legislativo é visualizado como um dos pilares sustentadores da democracia. Nesse sentido, estão à frente do referido poder os parlamentares, os quais têm imunidades parlamentares. A partir disso diz que esse estudo tem como finalidade analisar a sistemática das Imunidades Parlamentares, bem como discorrer sobre o instituto presente no Ordenamento Constitucional Brasileiro, como também sua origem, finalidade e espécies, sabendo-se que o Poder Legislativo como um todo e seus membros, atuam com caráter de independência e liberdade no exercício de suas funções constitucionais. A partir disso, vê-se que o referido conjunto de regras é compreendido na presente pesquisa com o intuito de poder colocar em tese o tema referente A Imunidade Parlamentar no Direito Constitucional Brasileiro, a divisão desse instituto em imunidade material e imunidade formal, quais os parlamentares que gozam dessa prerrogativa, a imunidade de Deputados Estaduais e Vereadores, bem como as motivações que levam os parlamentares a possuírem referidas garantias que os imunizam, a perda do mandato pela cassação ou extinção, bem como o foro privilegiado, suas críticas e uma análise de casos concretos. Isso fará com que haja uma melhor compreensão acerca do comportamento dos parlamentares que tiveram os mandatos cassados.From an initial perspective, the Legislative Power is seen as one of the pillars supporting democracy. In this regard, parliamentarians, who enjoy parliamentary immunities, are at the forefront of this power. This study aims to analyze the systematics of Parliamentary Immunities and discuss the institute present in the Brazilian Constitutional Order, as well as its origin, purpose, and types, considering that the Legislative Power as a whole and its members act with independence and freedom in the exercise of their constitutional functions. From this, it is observed that this set of rules is understood in this research with the intention of theoretically addressing the topic of Parliamentary Immunity in Brazilian Constitutional Law, dividing this institute into material immunity and formal immunity, identifying the parliamentarians who enjoy this prerogative, the immunity of State Deputies and City Councilors, as well as the motivations that lead parliamentarians to have such guarantees that immunize them, the loss of mandate through revocation or extinction, as well as the privileged forum, its criticisms, and an analysis of specific cases. This will lead to a better understanding of the behavior of parliamentarians who have had their mandates revoked.
