Eleição suplementar : conceito, circunstâncias e motivações

Abstract

Analisa o conceito de eleição suplementar por meio do estudo da legislação, das decisões da Justiça Eleitoral e dos comentários de especialistas em Direito Eleitoral. Discute as questões da anulação e da nulidade de votos, votação e eleição, diretamente relacionadas ao tema. Aborda a ampliação das previsões legais que permitiram à Justiça Eleitoral cassar e impugnar candidaturas, diplomas e mandatos, o que redundou no aumento da realização de eleições suplementares. Por fim, enfoca as modificações que o art. 224 do Código Eleitoral sofreu em 2015 e que impactam essa problemática.It analyzes the concept of supplementary election through the study of legislation, the decisions of Electoral Court and comments from experts in electoral law. Discusses the issue of annulment and the null vote, voting and election as they are directly related to the topic. Argue the expansion of legal provisions that allowed the Electoral Court to annul and contest candidatures, certificates and mandates, which resulted in the increase the realization of additional elections. Finally, it focuses on the changes that art. 224 in the Electoral Code has suffered in 2015 and that will impact on this issue.
