Alistabilidade : qualidade jurídica do alistável

Abstract

A partir da interpretação das regras do art. 14, § 1º, I e II, e § 2º da Constituição Federal, o presente texto define o conceito jurídico alistabilidade, tratando-o como qualidade jurídica cujo conteúdo é direito subjetivo público de exigir do Estado brasileiro o alistamento eleitoral e cujos requisitos são, exclusivamente, ser brasileiro maior de 16 anos e não conscrito. Propõe-se que alistabilidade tem natureza de direito político e regime constitucional, não podendo sofrer redução por regra não-constitucional, mesmo da lei. São examinadas as consequências da utilização do conceito alistabilidade com essa definição e com essa natureza jurídica, tanto como instrumento de interpretação da diferença entre gozo e exercício dos direitos políticos, quanto de aplicação das regras que regulam os direitos políticos dos portugueses no Brasil bem assim aquelas referentes aos conscritos.Departing from the interpretation of the normativity of the article 14, § 1º, I e II, e § 2º of the Brazilian Federal Constitution, the present paper defines the juridical concept of electoral registration regarded as a juridical quality which content is the subjective right to demand from the Brazilian State the registration to vote, and which the requirements are only to be a Brazilian citizen aged 16 years and over and not conscripted in military service. It suggests that electoral registration has the nature of a political right and treatment according to the constitutional juridical system. It cannot suffer limitation by non-constitutional normativity, or even by law. It examines the consequences of using the concept of electoral registration under the proposed definition and juridical nature, specifically as a means for interpreting the difference between enjoyment and exercise of political rights. It concludes by examining its reverberations in the application of the norms ruling political rights of Portuguese citizens living in Brazil, as well as those ruling the military conscripted.
