Outro Financiamento de campanhas políticas e igualdade política : uma perspectiva liberal-igualitária(2011) Silva, Júlio César Casarin Barroso; Tribunal Superior EleitoralEm controversa decisão datada do mês de Janeiro de 2010, a Suprema Corte dos Estados Unidos - a pretexto da proteger a liberdade de expressão - declarou inconstitucional a legislação que colocava limites à doação e ao uso de dinheiro privado para o financiamento e os gastos das campanhas eleitorais e partidos políticos naquele país. Apresentando a evolução do entendimento da Corte sobre o tema e utilizando a perspectiva teórico-normativa conferida pelo liberalismo igualitário, o presente trabalho tem o escopo de analisar os fundamentos teóricos da decisão, bem como refletir sobre as implicações corrosivas que o desatamento do dinheiro corporativo no financiamento político pode ter sobre o que Rawls chamou de "valor equitativo das liberdades políticas".Artigo Private funding of political campaigns : comparative analysis of the law in the United States and in Brazil(2015) Monteiro, AlbertoThe topic of the present paper involves the law of private campaign finance, the regulation of the amount of money that individuals, legal entities or private groups can devote to support a preferred candidate or political party. The US Supreme Court has been showing a trend of abolishing limits on election spending. On the other hand, the Brazilian Supremo Tribunal Federal issued a partial decision on April 2nd, 2014 striking down the Brazilian framework of campaign financing by individuals and legal entities. In this article I engage in a comparative study of both jurisdictions to try to understand if and how each of them differs in the understanding of subjects that are relevant for the resolution of the issue of private campaign funding.
