Critérios para caracterização do ilícito da fraude à cota de gênero : breve ensaio comparativo da jurisprudência do TSE

Abstract

Tem por objetivo traçar um panorama detalhado do marco legal e da evolução legislativa acerca do ilícito de fraude à cota de gênero, por meio da análise da legislação e decisões judiciais e revisão bibliográfica da literatura acadêmica. Será abordada a complexidade inerente à tarefa de conceituar esse ilícito, bem como os desafios associados à identificação dos critérios concretos e objetivos para sua caracterização. O problema central da pesquisa deste artigo é investigar como e porquê a fraude à cota de gênero persiste no contexto político brasileiro, apesar dos avanços legislativos. A hipótese é de que ambiguidade legislativa, por vezes, contribuiu para a persistência da prática, tornando imperativa uma análise acurada da matéria.It aims to provide a detailed overview of the legal framework and legislative developments regarding the illegality of gender quota fraud, through an analysis of legislation, judicial decisions, and a bibliographic review of academic literature. The complexity inherent to the task of conceptualizing this illicit will be addressed, as well as the challenges associated with identifying concrete and objective criteria for its characterization. The central research problem of this article is to investigate how and why gender quota fraud persists in the Brazilian political context, despite legislative advancements. The hypothesis is that legislative ambiguity has sometimes contributed to the persistence of the practice, making a thorough analysis of the matter imperative.
