Investiga a competência da Justiça Eleitoral para julgar
crimes comuns conexos a crimes eleitorais, com foco no julgamento do Inquérito n. 4435/DF pelo Supremo Tribunal Federal (STF), o qual envolveu
crimes da Operação Lava Jato anulados pelo STF em razão da inobservância
da competência da Justiça Especializada. O tema é de alta relevância, pois o
processamento e o julgamento de crimes comuns conexos a crimes eleitorais
em varas criminais comuns, seja da Justiça Estadual ou da Justiça Federal,
conduzem à nulidade absoluta do processo por ofensa ao princípio do juiz
natural. O objetivo deste estudo é analisar os critérios jurídicos e doutrinários
que fundamentam a competência da Justiça Eleitoral para julgar os crimes
comuns conexos aos crimes eleitorais, destacando a jurisprudência e os
princípios envolvidos. A metodologia empregada inclui o estudo de casos
e a revisão bibliográfica, focando em textos normativos, doutrinários e
jurisprudenciais. Pretende-se examinar a evolução histórica da legislação e
da jurisprudência; avaliar o impacto do julgamento do Inquérito n. 4435/DF;
analisar a aplicação do princípio do juiz natural; elucidar que o juízo eleitoral
deve decidir sobre a conexão do crime comum ao crime eleitoral e sobre a
aplicação ou não da teoria do juízo aparente; comparar a competência da Justiça
Eleitoral com outras jurisdições especializadas; propor diretrizes para evitar
nulidades processuais; e analisar casos concretos e decisões jurisprudenciais.
A pesquisa visa esclarecer questões complexas sobre a competência criminal
da Justiça Eleitoral e reforçar a importância de um sistema de justiça capaz
de garantir a integridade das eleições e a proteção da democracia, observando
que o princípio do juiz natural é uma garantia constitucional basilar do Estado
democrático de direito.
It investigates the jurisdiction of the Electoral Court to adjudicate common crimes connected to electoral crimes, focusing on the judgment of Inquiry No. 4435/DF by the Brazilian Supreme Federal Court, which involved crimes from the "Operation Car Wash" that were annulled by the Court due to the disregard of the jurisdiction of the specialized court. The topic is highly relevant, as the processing and adjudication of common crimes connected to electoral crimes in ordinary criminal courts, whether state or federal, lead to the absolute nullity of the proceedings due to the violation of the principle of the natural judge. The objective of this study is to analyze the legal and doctrinal criteria that underpin the jurisdiction of the Electoral Court to adjudicate common crimes connected to electoral crimes, highlighting the jurisprudence and principles involved. The methodology includes case studies and bibliographic review, focusing on normative texts, doctrinal sources, and case law. The study aims to examine the historical evolution of legislation and jurisprudence, assess the impact of the judgment of Inquiry No. 4435/DF, analyze the application of the principle of the natural judge, clarify that the Electoral Court must decide on the connection between common crimes and electoral crimes, and whether or not the theory of apparent jurisdiction should be applied. Additionally, it compares the jurisdiction of the Electoral Court with other specialized jurisdictions, proposes guidelines to avoid procedural nullities, and analyzes concrete cases and judicial decisions. The research seeks to clarify complex issues regarding the criminal jurisdiction of the Electoral Court and reinforce the importance of a judicial system capable of ensuring the integrity of elections and the protection of democracy, emphasizing that the principle of the natural judge is a fundamental constitutional guarantee of the Democratic Rule of Law.
