O desequilíbrio dos três poderes e o sistema de freios e contrapesos : uma análise dos modelos presidencialista e parlamentarista

Abstract

Tem como objetivo analisar os sistemas de governo sob a ótica da teoria tripartite e sua crescente desconstrução. Nesse sentido, é fundamental analisar como o sistema de freios e contrapesos, enquanto ideia basilar dos três poderes, tem influenciado na estruturação dos sistemas representativos de governo, presidencialista e parlamentarista, e na concretização do (des)equilíbrio dos três poderes. O estudo conclui pela efetivação de um estado crítico de compreensão e credibilidade da teoria tripartite no país, o que atinge diretamente o sistema de governo adotado, sendo necessárias políticas claras de fortificação da unidade tripartite.It aims to analyze systems of government from the perspective of tripartite theory and its growing deconstruction. In this sense, it is essential to analyze how the system of checks and balances, as a fundamental idea of the three branches of government, has influenced the structuring of representative systems of government - presidential and parliamentary - and the realization of the (im)balance of these three branches. The study concludes that a critical state of understanding and credibility of tripartite theory has been achieved in the country, which directly affects the adopted system of government, necessitating clear policies to strengthen tripartite unity.
