Financiamento de campanha e ação afirmativa de gênero : um estudo sobre o julgamento da ADI 5617

Abstract

Estuda o julgado do Supremo Tribunal Federal na Ação Direta de Inconstitucionalidade nº 5617, de relatoria do Min. Edson Fachin, que inaugurou nova fase para o financiamento de campanhas eleitorais femininas no Brasil. Uma maior participação da mulher na política, como realização do princípio democrático, vem, vagarosamente, se delineando no país. A partir do julgamento estudado, fixou-se o incremento da efetividade de que careciam os discursos. Através de ação afirmativa, lastreada na isonomia constitucional, a distribuição de recursos para as campanhas ganhou novos contornos. O estudo parte, então, dos antecedentes históricos, transitando pelos marcos legais e jurisprudenciais pertinentes, para, em seguida, examinar os votos que compuseram o julgamento da ADI nº 5617. Após refletir sobre as limitações históricas e hodiernas, volta-se para uma perspectiva de futuro, consectária do julgado estudado, e conclui pela necessidade de permanente vigilância e proficiente atuação para que a busca da igualdade de gênero na política não mais se perca em mera retórica.

It studies the judgment of the brazilian Supreme Court in the Direct Action of Unconstitutionality no. 5617, rapporteurship of J. Edson Fachin, which inaugurated a new phase for the funding of women's election campaigns in Brazil. A greater participation of women in politics, as a realization of the democratic principle, is slowly taking shape in the country. From the judgment studied, it was established the increase in effectiveness that the speeches lacked. Through affirmative action, backed by constitutional equality, the distribution of resources for campaigns gained new contours. The study then starts from the historical background, moving through the relevant legal and jurisprudential frameworks, and then examines the votes that made up the judgment of ADI nº 5617. After reflecting on the historical and modern limitations, it turns to a perspective in the future, consectarian of the judged studied, and concludes by the need for permanent vigilance and proficient performance so that the pursuit of gender equality in politics is no longer lost in mere rhetoric.
