Questões pertinentes ao direito de alistamento e voto da pessoa com deficiência mental

Abstract

Realiza uma análise crítica do direito ao alistamento e voto da pessoa com deficiência mental, após a edição da Lei 13.146/2015. A análise leva em conta a profunda mudança no paradigma de tratamento legal à pessoa com deficiência, com a incorporação da Convenção Internacional sobre os Direitos das Pessoas com Deficiência ao nosso ordenamento jurídico com status de emenda constitucional. É realizada, ainda, uma breve descrição acerca dos tratamentos jurídico e social conferidos à deficiência mental ao longo da história. Espera-se que, ao final, seja confirmada a hipótese de que não há óbices legais ao alistamento eleitoral e ao exercício do direito de voto pela pessoa com deficiência mental.It conducts a review of the right to vote and enlistment of people with mental disabilities, after the enactment of Law 13.146/2015. The analysis takes into account the profound change in the paradigm of legal treatment to people with disabilities, incorporating the International Convention on the Rights of Persons with Disabilities to our legal system with constitutional amendment status. It will be held also a brief description about the legal and social treatment given to the mental disability throughout history. It is expected that in the end is confirmed the hypothesis that there are no legal obstacles to voter registration and the exercise of voting rights by persons with mental disabilities.
