Inelegibilidade reflexa por parentesco : o atual entendimento do TSE

Abstract

Por meio do método dedutivo-analítico, parte-se de uma compreensão geral das condições de elegibilidade e das causas de inelegibilidade, com foco na inelegibilidade por parentesco, utilizando-se da pesquisa documental indireta, mediante pesquisa bibliográfica, realizada por livros e precedentes jurisprudenciais. Dessa forma, buscou analisar o entendimento adotado pelos Tribunais em relação à inelegibilidade prevista no art. 14, § 7º, da Constituição Federal, a qual atinge o cônjuge e os parentes até o segundo grau do Chefe do Poder Executivo na circunscrição eleitoral em que exerça o respectivo mandato eletivo. Assim, a partir da análise da Súmula Vinculante n.º 18, bem como de entendimentos jurisprudenciais, concluiu-se que o intérprete da norma deverá, sempre que possível, conferir interpretação restritiva e teleológica quando da análise da incidência da inelegibilidade por parentesco, em observância à finalidade da norma, que se consubstancia em obstar a hegemonia política de um mesmo núcleo familiar, dando efeito ao regime democrático vigente no Brasil e possibilitando a alternância no poder.

Using the deductive-analytical method, it started from a general understanding of the eligibility conditions and the causes of ineligibility, focusing on ineligibility in parentheses, using indirect documentary research, through bibliographical research, carried out by books and jurisprudential precedents. In this way, it sought to analyze the understanding adopted by the Courts in relation to the ineligibility provided for in art. 14, § 7, of the Braizilian Federal Constitution, which affects the participation and relatives up to the second degree of the Head of the Executive Branch in the electoral district in which he exercises the respective elective mandate. Therefore, based on the analysis of Binding Precedent nº18, as well as jurisprudential understandings, it was concluded that the interpreter of the rule must, whenever possible, provide a restrictive and teleological interpretation when analyzing the incidence of ineligibility due to kinship, in compliance with the specifically the norm, which consists of preventing the political hegemony of the same family nucleus, giving effect to the democratic regime in force in Brazil and enabling alternation in power.
