Filho de criação e inelegibilidade reflexa por parentesco : uma contribuição da realidade sertaneja para a teoria das inelegibilidades

Abstract

Observa em qual medida os efeitos da afetividade atingem o processo eleitoral, por meio da análise de um leading case do Tribunal Superior Eleitoral proferido no Recurso Especial Eleitoral 54101-03/2008. Trata-se de uma ação em que se questiona a existência da inelegibilidade prevista no artigo 14, §7º, da Constituição Federal, a inelegibilidade reflexa por parentesco, que incide sobre o cargo de chefia do Poder Executivo. A lide gira em torno do debate sobre a possibilidade do reconhecimento da filiação socioafetiva, entre o prefeito eleito na cidade de Pau D'arco do Piauí, em razão de ser filho de criação do ex-prefeito reeleito do município. A discussão perpassa as consequências da constitucionalização do Direito Privado, que proporcionou uma quebra de paradigmas, a ampliação e o surgimento de novos conceitos no âmbito das relações de parentesco. O julgado foi muito importante pois possibilitou a abertura de precedentes no que tange ao reconhecimento da filiação socioafetiva, demonstrando também a postura ativista da Justiça Eleitoral que contribuiu para evitar a existência de desequilíbrios como a formação de oligarquias e fraudes nos pleitos eleitorais.

It observes the extent to which the effects of affectivity affect the electoral process, through the analysis of a leading case of the Higher Electoral Court rendered in Electoral Special Appeal 54101-03 / 2008. This is an action that questions the existence of the ineligibility foreseen in article 14, §7º of the Federal Constitution, the reflex ineligibility for kinship, that focuses on the position of head of the Executive Branch. The lawsuit revolves around the debate about the possibility of recognition of the socio-affective affiliation between the mayor elected in the city of Pau D'arco do Piauí, due to being foster child the ex-mayor re-elected mayor of the municipality. The discussion pervades the consequences of the constitutionalization of Private Law, which has provided a breakdown of paradigms, the expansion and the emergence of new concepts in the context of kinship relations. The trial was very important because it made it possible to open precedents regarding the recognition of the existence of socio-affective filiation, also demonstrating the activist position of the Electoral Justice that contributed to avoid the existence of imbalances such as the formation of oligarchies and fraud in electoral lawsuits.
