Um breve ensaio acerca do manicômio jurídico eleitoral : a terapêutica de alfredo Augusto Becker aplicada ao direito eleitoral

Abstract

Fundamenta-se na obra de Alfredo Augusto Becker. A irreverência do jurista gaúcho, em seu Teoria Geral do Direito Tributário, é aqui invocada para ilustrar o estado de coisas manicomial vigente no âmbito do Direito Eleitoral brasileiro. O trabalho sugere o uso da terapêutica proposta por Becker para resgate da atitude mental jurídica nos domínios do Direito Eleitoral, sobretudo mediante a investigação da estrutura lógica da regra jurídica e da sua atuação dinâmica. Ancorado na metodologia desenvolvida por outro tributarista, Paulo de Barros Carvalho, o ensaio destaca a importância do esquema lógico- -semântico da regra matriz de incidência como meio para o aperfeiçoamento da ciência do Direito Eleitoral. Com base nisso, construímos a norma jurídica que temos apresentado como regra matriz de elegibilidade.

Leveraging the unconventional perspective of this Rio Grande do Sul academic writer, as expounded in his General Theory of Tax Law, we shed light on the current chaotic state of affairs within Brazilian Electoral Law. Our aim is to propose Becker's therapeutic approach as a means to restore a more reasoned legal mindset within the realm of Electoral Law. This entails delving into the logical framework of legal rules and their dynamic application. Grounded in the methodology pioneered by another eminent tax law scholar, Paulo de Barros Carvalho, our essay underscores the significance of the logical-semantic structure of the incidence matrix-rule in refining the study of Electoral Law. Through this lens, we constructed the legal framework, presented herein as the eligibility matrix-rule.
