Em busca de maior efetividade da cota de gênero no direito brasileiro : análise de precedentes do Tribunal Superior Eleitoral e de propostas legislativas em tramitação sobre o tema

Abstract

Trata da participação de mulheres na política, especificamente da cota de gênero legislativa instituída no art. 10 da Lei nº 9.504/97, traçando um histórico desde sua criação até os dias atuais com o objetivo de analisar a sua eficácia como ação afirmativa. Por meio de pesquisa teórica e documental, analisa os resultados das últimas eleições, a atuação da Justiça Eleitoral, especialmente do Tribunal Superior Eleitoral, para a fiscalização da aplicação da cota e os principais projetos de alteração legislativa em trâmite no Congresso sobre o tema. Com base nos elementos levantados, conclui-se que a cota de gênero atual não é eficaz e que são necessárias alterações nas leis brasileiras, mas também uma construção firme sobre a importância da participação equânime de mulheres na política para garantia de seus próprios direitos e para a promoção da democracia.It analyzes the legal gender quota currently stated in article 10 of the brazilian federal law n. 9.504 / 97, with a brief historical account with the intent of evaluating its efficiency. Based on a theoretical and documentary research methodology, it covers the statistics of the last elections generated by the Supreme Electoral Court, the actions of te Electoral Justice towards monitoring of quota compliance and the current legislative proposals on the matter. The information gathered by the work leads to the conclusion that the current gender quota does not produce the desired results and therefore that changes are in need. Changes in legislation but also the reaffirmation of the importance of equal participation of women in politics to guarantee their own rights and to promote democracy.
