Fiel representação política : escopo do processo eleitoral

Abstract

Com escopo democrático, a Carta Constitucional de 1988, depois de longo processo histórico, deu fim à ditadura militar, abrindo um ciclo de amplas garantias e direitos para todos os brasileiros. Em especial, conferiu possibilidade de ingerência nas questões mais relevantes da Nação, consagrando o referendo, o plebiscito, a iniciativa popular e o voto direto e secreto, com igual valor para todos, como expressões da soberania do povo, titular do poder estatal. Desde então, cresceu o número de votantes, candidatos, partidos políticos e até de unidades federadas. Acirradas disputas passaram a ser exibidas no horário da propaganda política. Terminado o prélio, nada raro, as agremiações partidárias, que ocupam relevante papel no regime democrático, após meses de caminhada, entram em litígio com seus militantes arguindo infidelidade política. O tecido social brasileiro é complexo, multicultural, fracionável em camadas de interesse distintas. Essa variedade, em tese, deve ser lealmente espelhada tanto na gestão da coisa pública, quanto na atividade legislativa. Pensando nisso, este estudo se propõe a analisar o pacto de vontades firmado entre candidatos, siglas e sufragistas, salientando a necessidade de revisão do arcabouço normativo que rege a matéria, com vistas ao fim maior das eleições: construir representações políticas que, ao longo do mandato eletivo, sejam coerentes com a linha ideológica e propostas assumidas em campanha, tendo em vista que os cidadãos, fonte e razão de ser do governo, não podem ser relegados à exclusiva condição de súditos após a proclamação do resultado das urnas.

With a democratic scope, the 1988 Constitutional Charter, after a long historical process, ended the military dictatorship, opening a cycle of broad guarantees and rights for all brazilians. In particular, it conferred a possibility of interference in the most relevant issues of the nation, consecrating the referendum, plebiscite, popular initiative and direct and secret vote, with equal value for all, as expressions of the sovereignty of the people, holder of State Power. Since then, the number of voters, candidates, political parties and even federal units has grown. Fierce disputes began to be displayed at the time of political advertising. After the prelude, not unusual, the party associations, which occupy a relevant role in the democratic regime, after months of walking, enter into litigation with their militants arguing political infidelity. The brazilian social composition is complex, plural, fractional in distinct layers of interest. This variety, in theory, must be loyally mirrored both in the management of public affairs and in legislative activity. With this in mind, this study proposes to analyze the pact of will signed between candidates, political parties and suffragettes, stressing the need to revise the normative framework governing the matter, with a view to the greater end of the elections: to build political representations that, throughout the elective mandate are consistent with the ideological line and proposals made in campaign, given that the citizens, source and reason of being of the government, can not be relegated to the exclusive condition of subjects after results of the electoral contest.
