à emergência do governo representativo.
It analyzes the confusion that has arisen in modernity between democracy and representative government, which has led to an imaginary that electoral process of choosing the representatives is synonymous with democratization of the decision-making processes (among which is the process of drafting the law). In this analysis, the main theoretical references are The principles of representative government, of Manin, and Democracy and its critics, of Dahl. As explained, in modernity, several movements emerge, in order to expand participation in decision-making processes, which leads to the emergence of representative government. It tries to provide political participation. However, representative government is based on the belief that the electoral process would be able to account for these claims, creating a confusion between democracy and election, leading to a constant process of legal-political crises.
