Propaganda eleitoral irregular e seus efeitos : um breve histórico

Busca mostrar que a propaganda eleitoral, nos moldes que se apresenta atualmente, não tem o poder de garantir o equilíbrio de igualdade entre os participantes da disputa eleitoral. O referido trabalho baseou-se em doutrinas trazidas por autores como Angher (2008), Coneglian (2004) Rollo (2004) e Sant'anna (1998) dentre outros, além de pesquisa em sites sobre o tema e nos textos legais que disciplinam o pleito eleitoral. A metodologia utilizada para tanto foi o comparativo entre as
normas e teorias que regem a propaganda e a legislação existente. Chegou-se à conclusão
que as punições impostas pelos textos e aplicadas nos julgados não coíbem a propaganda
irregular e, por isso, a igualdade entre os concorrentes fica comprometida.
It intends to show that electoral propaganda, as it currently stands, does not have the power to guarantee a balance of equality between the participants in the electoral contest. This work was based on doctrines brought by authors like Angher (2008), Coneglian (2004) Rollo (2004) and Sant'anna (1998) among others, in addition to research on sites about the subject in the legal texts that discipline the electoral process. The methodology used for this was the comparative between the norms and theories that discipline the advertising and the existing legislation. The conclusion was reached that the punishments imposed by the texts and applied in the judgments do not restrain the irregular propaganda and therefore the equality between the competitor is compromised.
