O Art. 41-A da Lei 9.504/97 e sua importância como um dos mecanismos de busca do fortalecimento da democracia

Abstract

Investiga a importância do combate à captação ilícita de sufrágio para o fortalecimento da democracia. Partindo de uma exegese pormenorizada do art. 41-A da Lei N° 9.504/97, demo nstrando como se deu sua inserção no ordenamento jurídico pátrio, objetiva-se destacar o dispositivo em comento e avaliar sua contribuição para tutelar a liberdade de escolha do eleitor. Interessa analisar a orientação da doutrina e jurisprudência pátrias, revelando as principais inclinações da Corte Superior Eleitoral com relação ao artigo em estudo. Deve-se relatar também os aspectos atuais que norteiam a prática da compra de votos, aclarando a aplicação e efetividade do art. 41-A da Lei das Eleições. Utilizando-se da pesquisa bibliográfica, pretende-se divulgar a força do art. 41-A, pontuando sua real colaboração para proteger a vontade do eleitor no exercício da cidadania e para o aperfeiçoamento do regime democrático.It investigates the importance of the combat to the illicit reception of vote for the invigoration of the democracy.
