A Justiça Eleitoral e o enfrentamento as fake news impulsionadas pelas redes sociais

Abstract

A eleição brasileira de 2018 foi marcada pela proliferação das chamadas fake news, acionadas por algoritmos de aplicativos que proporcionam interações entre atores. Nesse contexto, o meio WhatsApp (principalmente) foi utilizado como propagador das notícias fraudulentas. O alvo determinante foi o campo político, mas, inevitavelmente, atingiu às normas da Justiça Eleitoral, colocando em dúvida os alicerces da democracia contemporânea. Nesse artigo. relatam-se as defasagens do campo jurídico e comunicacional frente aos novos ambientes, bem como os esforços adaptativos dos tribunais eleitorais. Entretanto, a instituição eleitoral - tanto em termos gerais, como especificamente em relação às fake news - desenvolveu um sistema de respostas em interlocução com outras instituições, em conversação com atores e, em particular, em parceria com a impressa profissional e as agências de checagem de notícias. Buscou-se explicitar essas práticas sociais analisando as normas em relação ao novo ambiente (redes sociais) em relação às fake news.

The brazilian election of 2018 was marked by the proliferation of the so-called fake news, triggered by application's algorithms that provide interactions between the agents. In this context, the WhatsApp (mainly), a communication media, was used as a spreader of fraudulent news. The decisive target was the political field but inevitably it reached the norms of Electoral Justice, putting in doubt the foundations of contemporary democracy. In this paper it reports the gaps in the legal and communication field in the face of new issues, as well as the adaptive efforts of the electoral courts. However, the electoral institution - both in general terms and specifically in relation to fake news - has developed "a system of responses" in dialogue with other institutions, in conversation with agents and, in particular, in partnership with the professional press and checking fact agencies. We seek to make these social practices explicit by analyzing the rules in relation to the new environment (social medias) and in relation to fake news.
