Abstract

Tem como foco a análise da proteção de dados nas eleições, haja vista a linha tênue existente entre a importância da proteção de dados dos eleitores e a cada vez mais invasiva e tecnológica propaganda eleitoral. Para tanto, utiliza o método-hipotético dedutivo, testando a hipótese de que seguindo o exemplo do que acontece nos países União Europeia com o Regulamento Geral de Proteção de Dados Pessoais, o Brasil, mesmo com a futura entrada em vigor da Lei Geral de Proteção de Dados Pessoais (LGPD), carecerá de regulamentações específicas. A pesquisa revelou que a LGPD é genérica, porém traz princípios e conceitos relevantes para a proteção dos dados dos eleitores, devendo, portanto, ser reproduzida nas disposições legais específicas acerca da temática.

It focuses on the analysis of data protection in elections, given the fine line that exists between the importance of voter data protection and the increasingly invasive and technological electoral propaganda. For this purpose, it uses the hypothetical deductive method, testing the hypothesis that following the example of what happens in the European Union countries with the General Regulation for the Protection of Personal Data, Brazil, even with the future entry into force of the General Protection Law Personal Data (LGPD), will require specific regulations. The survey revealed that the LGPD is generic, but brings relevant principles and concepts for the protection of voter data, and should therefore be reproduced in specific legal provisions on the subject.
